A Certificate of Compliance is required when there is a question about the legality of a parcel of land. Its purpose is to assure that a parcel of land was legally created in conformance with the Subdivision Map Act.
- complete the application
- submit application, and a copy of the vesting deed, preliminary title report and the "chain of title" to:
Planning Division Development Review Services 777 B Street Hayward, CA 94541-5007 The City Surveyor reviews the documents to determine whether the parcel was created in conformance with the Subdivision Map Act. The applicant will be notified by mail of the results.
Either:
- The review confirms that the parcel was legally created. The Certificate of Compliance is then prepared and recorded with the Alameda County Recorder; OR
The parcel was not legally created. A Conditional Certificate of Compliance is prepared, recorded with the Alameda County Recorder, and mailed to the applicant with conditions that must be met.
Important to note: The issuance of a Certificate of Compliance does not guarantee that a parcel is a legal building site. There may be building or zoning issues to be resolved before a building permit may be issued. For more information, please call Development Review Engineer at 510-583-4111
