Because most driveways are located in the City or State right-of-way and are considered part of the public street, an encroachment permit is required prior to any construction or repair work. Also, all work must be done according to City or State standards.
The State of California Department of Transportation (Caltrans) must grant a State encroachment permit for construction or modification of a driveway on State Highways within Hayward. They include Foothill Boulevard, Jackson Street, and Mission Boulevard.
The City has four Standard Details for driveways that apply under different circumstances. They apply to:
- sidewalk less than 8 feet (SD-108A)
- local & collector streets (SD-109)
- arterial streets (SD-110)
- temporary access to property during construction (SD-111)
