State law requires owners or operators of aboveground petroleum storage tanks that exceed threshold capacities or total aggregate quantities to file a storage statement with the Hayward Fire Department's Hazardous Materials Office and to prepare and implement a federal SPCC Plan. The SPCC plan, certified by a professional engineer, is designed to prevent discharges of petroleum and petroleum products from reaching navigable waters.
A facility storing "petroleum products" in a single tank with a capacity greater than or equal to 1,320 gallons or in aboveground tanks or containers with a cumulative storage capacity greater than or equal to 1,320 gallons must prepare an SPCC plan.
The Hazardous Materials Office will verify during an inspection that an SPCC Plan, if required, has been prepared and is being implemented.
