Hayward’s Inclusionary Housing Ordinance requires that a certain percentage of new residential developments units be made affordable to low and moderate-income households. This includes both ownership and rental developments consisting of 20 or more units.
REQUIREMENTS:
1. Affordable Rental Units - applies to all new rental developments with 20 or more units:
- 7.5% of the units must be affordable to households earning no more than 50% of the Area Median Income (AMI);
- 7.5% of the units must be affordable to households earning no more than 60% of the Area Median Income (AMI);
- Monthly rent, plus an allowance for utility costs, must not exceed 30% of the maximum eligible monthly income;
- All affordable units must reflect the number of bedrooms provided in the development as a whole, and shall not be distinguished by design, construction, or materials.
2. Affordable Ownership Units - Applies to all new ownership developments consisting of 20 or more units. Important Ordinance requirements include:
- 15% of the units must be made affordable to households earning no more than 120% of the Area Median Income (AMI) for a term of no less than 45 years;
- Affordable housing costs (mortgage payment, taxes, utilities, insurance, and condo fees, if applicable) must not exceed 35% of 110% of the Area Median Income (AMI), adjusted for house size;
- Affordable housing units should be dispersed throughout and be integrated with housing development as a whole; and
- Unit mix of affordable units must reflect the unit mix of the entire housing development.
