There is a requirement to dedicate land, or pay an in-lieu fee for public park and recreational purposes as a condition of approval of the following applications for residential purposes:
- tentative subdivision map
- parcel map
- use permit
- planned development
- site plan review, or
- building permit
Steps include:
- Developer indicates a preference to either dedicate land, pay an in-lieu fee, or do a combination of both upon filing of a development plan for approval;
- City determines the requirement: dedication of land, payment of an in-lieu fee, or a combination of both for subdivisions or developments containing more than 50 dwelling units;
- For those containing 50 dwelling units or less, only the payment of an in-lieu fee is required;
- Qualifying private park and recreational areas may receive partial credit against dedication or fee requirement.
