The Chief of Police has the authority to issue concealed weapons permits to private persons. Concealed weapon permit is issued only under rare and exigent circumstances:
- upon proof that the person applying is of good moral character;
- that good cause exists for the issuance;
- that the person applying is a resident of Alameda County.
A concealed weapon permit may include any reasonable restrictions or conditions, including restrictions as to the time, place, manner, and circumstances under which the person may carry a firearm capable of being concealed upon the person.
Good cause may be determined by a clear and present danger to the life of, or great bodily injury to, the applicant, spouse, children, or other member of the immediate family, which cannot be adjudicated by alternative forms of intervention. The applicant must meet several other criteria before a permit would be issued, including:
- complete a certified firearms safety course
- pass a written examination
- pass a firearms proficiency test
- submit to a psychological examination at the applicant's expense
- submit to a polygraph examination at the applicant's expense
- obtain a liability insurance policy or rider, which has a Hold Harmless clause.
