The City of Hayward has funded a program to help property owners repair or replace displaced, lifted, or broken sidewalks, even though California State Law places the responsibility to maintain and repair sidewalks on the adjacent property owner alone. The City Council’s program pays the majority of the costs, but requires the property owner to contribute a fixed amount as well.
The City determines which damaged sidewalks will be replaced each year based on the degree of sidewalk lift or displacement. The City follows the following procedure to develop an annual sidewalk repair and replacement contract:
- City staff inspects sidewalks in various areas of Hayward to see how much the sidewalks are raised or displaced;
- City staff maintains a list of impacted sidewalks and prioritizes the replacement projects annually according to the safety risk posed by the conditions found
- Property are notified by letter if their sidewalk is to be included in the next contract.
For environmental reasons, street trees will not be removed (even though their roots may have damaged the sidewalk) unless the tree is diseased, in imminent danger of falling or there is no other way of repairing the sidewalk without removing the tree. A new tree will be planted to replace any tree that is removed. The cost to the homeowner is $550 per single-family property.

In cases of financial hardship, property owners will be permitted to extend payments over 12 months. If a property owner is unable or unwilling to make payments, the amount will be placed as a lien against the property for payment upon sale of the property.
When sidewalks are repaired for multi-family dwellings, the group of units will be charged $550 for sidewalk repairs necessitated by damage from one or two trees, and an additional $550 per damaged sidewalk area necessitated by each additional tree.
